For purchasing and using class passes/ memberships, and studio facilities. By purchasing a class or pass and/ or attending classes you agree to the following terms and conditions:
- Please keep your teacher informed before every class if you have any new or existing injuries, medical conditions or you are pregnant, as we see many students in a group setting each week
- All passes must be used within the timeframe stipulated, which commences on the day of purchase, or if a course, the first date of the course. Missed classes can be made up within the timeframe stipulated, only at the location of purchase
- All passes are non transferable
- Class fees are non refundable, except in extenuating circumstances – please email to have your case assessed
- A 24 hour cancellation policy applies to all classes and courses . For cancellations made less than 24 hours, clients will incur the full cost of the class. Email is required to cancel.
- If a refund is granted, the booking fee of 2.2% is non refundable
- Suspension requests due to injury or illness must be submitted via email
- Payment and bookings are due on or before your first class
- Changes in class teachers, times, or cancellations may from time to time. No refunds are possible due to these changes
- No parking is allowed on Hubert St site before 8am and after 6pm
- Please spray and clean shared equipment
- Bookings made for others using your pass assume all parties agree to these terms and conditions and waiver and release
For unlimited monthly membership
1) This contract entitles the user to unlimited Yoga classes for the duration of its validity.
2) This contract only entitles the authorised member to attend classes, and in that member’s absence, cannot be transferred.
3) This contract may be transferred into the name of another partner permanently, if agreed by Stillness in Motion Yoga and all other involved parties.
4) This contract enables a monthly direct debit of $159 unless otherwise specified by a promotion.
5) This contract continues each month unless formally cancelled by email by the member. There is a minimum one month notice period for any cancellations. This means upon receiving your request for cancellation, a minimum of one monthly payment will be deducted before contract is fully terminated.
6) This contract cannot be paused or suspended, unless agreed upon by Stillness in Motion Yoga on a case by case basis.
7) This contract entitles the user to attend all regular classes listed on the Stillness in Motion Yoga timetable but does not entitle the member to attend workshops or events.
8) Membership will be placed on pause only in the instance where Stillness in Motion Yoga is directed by the Government to cease business for more than 7 days.
For class or Event participation and practice. By purchasing a class or pass and/ or attending classes you agree to the following terms and conditions, waiver and release:
Additional to the above, if at any time during the class, you feel discomfort or strain, increased pain, feel faint, dizzy or shortness of breath, stop and gently come out of the posture. You may rest at any time during the class. It is important in yoga that you listen to your body, and respect its limits on any given day.
I understand that yoga includes physical movements as well as an opportunity for relaxation, stress re-education and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will listen to my body, discontinue the activity, and ask for support from the teacher, but it will be your responsibility to choose the right option for you.
I assume full responsibility for any and all damages, which may incur through participation and the participation of any children or babies.
I understand that Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. By agreeing to this waiver, I affirm that a licensed physician has verified my good health and physical condition to participate in such a fitness program, if required. In addition, I will make the teachers aware of any medical conditions or physical limitations before class. If I am pregnant, become pregnant or I am post-natal or post-surgical, my agreement verifies that I have my physician’s approval to participate. I also affirm that I alone am responsible to decide whether to practice yoga and participation is at my own risk.
Additionally, the facility, teachers and Stillness in Motion Yoga are not in any way responsible for any loss or damage of your personal property.
Those under 18 years of age must email Stillness in Motion Yoga and have these terms agreed to by a guardian.
If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.
I hereby agree to irrevocably release and waive any claims that I have now or may have hereafter (including damages, costs, expenses, legal costs) against Stillness in Motion Yoga, its teachers, directors, employees, contractors and all related facilities and premises arising directly or indirectly out of acts or omissions any personal injury or negligence related to myself and or any children in my care and covenant not to sue Stillness in Motion Yoga, its teachers, directors, employees, contractors and all related facilities and premises in respect of any such claims against Stillness in Motion Yoga, its teachers, employees, contractors and all related facilities and premises .
For zoom and online classes. By purchasing a class or pass and/ or attending classes you agree to the following terms and conditions, waiver and release:
Additional to the above, it is your responsibility to ensure there is a capable adult at home with you when you are practising an online class and that they are aware of your session and able and willing to offer assistance in case of any illness or emergency.
If you are unable to have an aforementioned adult present in your place of yoga practise, it is your responsibility to provide an emergency contact to your teacher before each class.
Be sure that the yoga practise environment is safe and free of obstacles, that you have a non-slip mat for standing poses and that any chair used is stable.
Retreat and Teacher Training Terms and Conditions:
1. Cancellations.
If you wish to cancel your retreat you must notify Stillness in Motion Yoga Pty Ltd in writing. Once we’ve received your notice, cancellation will take effect subject to the following: The deposit is non refundable. If cancellation takes place 120 or more days prior to arrival 50% of the total retreat price will be forfeited. If cancellation takes place 60 days prior to your retreat’s start date, 80% of the total retreat price will be forfeited. If cancellation takes place 30 days prior to your retreat’s start 100% of the retreat price will be forfeited.
2. Cancellation due to lack of bookings.
Stillness in Motion Yoga Pty Ltd has the right to cancel the retreat if there are too few people booked in which case you will be give a part refund, minus any deposit made by Stillness in Motion Yoga Pty Ltd to the accommodation venue. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport, flight, and vaccination costs.) Therefore, Stillness in Motion Yoga Pty Ltd recommends you have travel insurance for international retreats.
3. Force Majeure.
If Stillness in Motion Yoga Pty Ltd and the trip leader are prevented (directly or indirectly) from performing any of their obligations under this agreement by ‘acts of God’, strikes, trade disputes, fire, breakdowns, pandemics, interruption of transport, government or political action, acts of war or terrorism, acts or omissions of a third party or for any other cause whatsoever outside Stillness in Motion Yoga Pty Ltd and the trip leader’s reasonable control, Stillness in Motion Yoga Pty Ltd and the trip leader will be under no liability whatsoever to you and may either cancel the retreat or take any other action as specified in condition four.
4. Assumption of Risk.
You acknowledge adventure travel is more challenging and demanding with a commensurately higher level of risk compared with conventional vacations, and it involves potential exposure to injury and that in the countries and regions in which adventure travel is undertaken, standards of accommodation, transport, health care, hygiene, safety and service provision generally are often not as high as those standards in your country of residence and may require flexibility and patience on your part. You further acknowledge that operational control of the retreat will be in the hands of a third party and that your right of action in regard to any shortcomings of that third party’s performance is against the third party and not against Stillness in Motion Yoga Pty Ltd.
5. Release and Waiver of Liability.
In consideration of Stillness in Motion Yoga Pty Ltd accepting your reservation you release, waive, discharge, hold harmless and agree to indemnify Stillness in Motion Yoga Pty Ltd, its officers, its employees, its agents, its licensees, other representatives, and trip leaders from all claims, actions or losses for bodily injury, emotional trauma, property damage, wrongful death, loss of services, loss of profits, as well as consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during your travel in connection with the retreat or any activities conducted in conjunction there within unless caused by the wilful negligence or wrongful act of Stillness in Motion Yoga Pty Ltd and its employees. Regardless of the situation or circumstances giving rise to the claim, you waive any claims you have, or may at any time have, against Stillness in Motion Yoga Pty Ltd and its employees, you agree, by accepting the additional inherent dangers and risks associated with the retreat, not to make any claim against or seek any compensation from Stillness in Motion Yoga Pty Ltd and its employees in respect to any personal injury, illness or death suffered by you or damage to or loss of property sustained by you as a result of your participation in the retreat including without limitation, any extracurricular activities you may engage in during the retreat, whether or not sponsored by Stillness in Motion Yoga Pty Ltd.
6. Changes, Postponement, Cancellation or Delay
Stillness in Motion Yoga Pty Ltd reserves the right to make changes to any aspect of the retreat if, in the absolute discretion of Stillness in Motion Yoga Pty Ltd, it is necessary to do so due to conditions that are likely to be hazardous or dangerous or due to any other adverse or threatening conditions whether political or military or terrorist or otherwise or if an act of omission of a third party prevents the retreat or the aspect of the retreat being undertaken in accordance with your booking or for any other reason considered necessary by Stillness in Motion Yoga Pty Ltd. If the designated trip leader is unable to lead the trip for any reason, Stillness in Motion Yoga Pty Ltd, in its discretion will enlist another teacher to lead the retreat. In the event of any change, modification, cancellation, postponement or delay under this condition, you acknowledge that you will have no right of refund of the retreat price in whole or in part and no right to claim compensation for any injury, loss or damage or other additional expenses incurred by virtue of the change, modification, cancellation, postponement or delay. Stillness in Motion Yoga Pty Ltd also reserves, in its absolute discretion, the right to cancel any retreat due to any government travel warning or advice, or any change in such warning or advice. In this event, we will do all we can to transfer any payments made to a future retreat with Stillness in Motion Yoga Pty Ltd. If this is not possible, travel insurance may compensate you depending on the circumstances.
7. Insurance.
We strongly recommend the purchase of travel insurance for International retreats and personal insurance for retreats in your home country. It is your responsibility to ensure that you are adequately insured for the full duration of the retreat in respect to illness, injury, death, loss of personal items, cancellation, and curtailment.
8. Travel Documents and Vaccinations
It is you responsibility to learn about and obtain all required travel documents, vaccinations, etc. for travel to the chosen destination. Stillness in Motion Yoga Pty Ltd is not responsible for any delays or cancellations due to client’s lack of proper travel documents.
9. Photography
Stillness in Motion Yoga Pty Ltd reserves the right to use photographs or videos from the retreat for promotional purposes. By making a reservation with Stillness in Motion Yoga Pty Ltd, you agree to allow your image to be used in such photography. If you prefer for your image not to be used, please notify Stillness in Motion Yoga Pty Ltd in writing before the retreat commences.
